These Terms and Conditions of Purchase and Use ("Terms") are between Casting360 and "you", the person using Casting360 materials, web site and Member Services department ("Our Services"). By using Our Services you accept the Terms.
In order to become a Member, you must be at least 18 years of age or have parental permission to be a part of Casting360. You must also agree that your registration information is accurate, that you are not misrepresenting yourself in any way, and that you will not share your username, password, or account information with any other person. Casting360 services should not be used for any improper, objectionable or immoral purposes.
Casting360 is not a talent agency, employer or a talent scout; the site is only a venue. Casting360 does not promise or facilitate employment. The number of casting calls available varies by location, roles available and the level of experience required. As with any business, results may vary, and will be based on individual capacity, experience, expertise, and level of desire. There are no guarantees concerning the level of income the user may experience.
All Casting360 Members pay a registration fee (currently $1.98) for the online portfolio. Online portfolios are posted on the Casting360.com website for casting directors and producers to view and contact Members directly for upcoming projects. Online portfolio consists of photos submitted by the Member and information about the Member's interests, skills, experience and other pertinent information that allows the opportunity for the Member to be positioned in front of entertainment professionals. As long as you are a registered Member of Casting360, your online portfolio will remain active on Casting360.com and viewable by industry professionals.
New Members receive a 14-day trial in which they can submit to casting calls. After your 14-day trial period your membership continues at $34.90 per month and will be automatically charged/debited on or about that same date to the credit card you provide today or from the checking account associated with the debit card you provide today. Your trial begins on the day you register as a Member of Casting360. The first monthly fee will be charged the day after your trial ends; monthly charges will be made on the same date in subsequent months. You are responsible for monthly charges for continuity membership while you are a Member of Casting360, even if you do not submit to casting calls or use other Casting360 services. You accept that Casting360 may change its fees or services at any time.
We guarantee that you will be contacted by a casting director within 90 DAYS after you become a Member of Casting360. If you are not contacted, we will gladly refund your registration fee.
You may cancel your continuity membership at any time with no further obligation. When your continuity membership ends, no future charges will take place and you will automatically lose access to casting call listings and certain other features of Casting360, but your online portfolio will remain active for talent searches by industry professionals. Cancellations must be made by telephone. Please call Member Support at 1-800-508-0298 Monday - Friday 7am - 5pm Pacific time.
If you have been a Member for 90 days and have not been contacted by a casting director, you are eligible for a refund of your registration fee (currently $1.98). Refund requests must be made by telephone. Please call Member Support at 1-800-508-0298 Monday - Friday 7am - 5pm Pacific time. If your registration fee is refunded, your online portfolio will be removed from Casting360.com and your continuity membership will automatically be canceled. Monthly fees for continuity membership paid prior to your cancelling are not refundable.
You agree not to access, reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of our services.
Casting360 is not responsible for any inappropriate, inaccurate, lewd, violent, or otherwise offensive content that any Member includes in their portfolio, photos, audio or video, or messages. However, Casting360 reserves the right to monitor communications between you and other Members as well as all content posted on the Portfolio, including text, photos, video and audio clips. Any content - including messages to other Members or Guests - may be rejected if they contain material that Casting360 considers inappropriate. You are solely responsible for your interactions with other Members, Guests, Casting Directors, or Photographers.
Examples of what may be considered inappropriate content:
If a messages include any of the above or any other content that Casting360 will label as inappropriate at our discretion, it may be rejected and not allowed on Casting360.
By posting any content on Casting360, you give Casting360 full permission to publish, display or use this content in any way within the Casting360 website, services, and company.
We will use your email to send you information about products and services we feel will be of interest to you. If you no longer wish to receive our promotional e-mails, please follow the unsubscribe instructions included in each promotional e-mail. In addition, if you opt to receive special offers from our trusted third party companies, we will share your e-mail address with them for this purpose. To change your sharing preferences, please contact us at firstname.lastname@example.org. To unsubscribe from these third party e-mails, please contact the applicable third party company directly.
Use of Personally Identifiable Information
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Web site.
We may collect certain non-personally identifiable information about you when you visit many of the pages of the Site. This non-personally identifiable information includes, without limitation, the type of browser that you use (e.g., Internet Explorer, Mozilla Firefox, Google Chrome), your IP address, the type of operating system that you use (e.g., Windows or Mac OS) and the domain name of your Internet service provider. We use the non-personally identifiable information that we collect to improve the design and content of the Site and to enable us to personalize your Internet experience. We also may use this information in the aggregate to analyze Site usage, as well as to offer you products and services. We also reserve the right to use aggregate or group data about our visitors for any and all lawful purposes. Aggregate or group data is data that describes the demographics, usage and/or characteristics of our visitors as a group. By visiting and/or supplying your personal information at the Site, you agree to allow us to provide such aggregate data to third parties.
If you use our blog on this Web site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums.
We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
When an end-user visits the Site, we send a cookie and/or gif file ("Cookie") to assign an anonymous, unique identifier to the applicable end-user's Internet browser. A Cookie is a piece of data stored on your hard drive containing non-personally identifiable information about you. Cookies have many benefits to enhance your experience at the Site. To disable and reject certain Cookies, follow the instructions associated with your Internet browser. Even in the case where a user rejects a Cookie, he or she may still use this Site. Casting360.com reserves the right to retain Cookie data indefinitely.
Casting360.com provides its users with the opportunity to receive special offers, products and/or services from third parties. Where you indicate the desire to receive certain offers, products or services from a third party during the applicable information collection process, your personally identifiable information that was provided during that Casting360.com information collection process will be shared with the applicable third party so that such third party may provide their product or service to you and so that you do not have to complete another information collection form to purchase or receive that product or service. Casting360.com does not store any personally identifiable information that you submit in order to receive such offers from third parties.
When you submit personally identifiable information through the Site, you have opted-in to receive information and marketing communications from the Third Party Provider. When contacted by any of these companies or third parties, you should notify them directly of your choices regarding the use of your information. To opt-out of having future third party marketing communications sent to you, you will be required to unsubscribe with the applicable third parties.
We do not knowingly collect information from minors under eighteen (18) years of age. No information should be submitted through the Site by individuals under eighteen (18) years of age. We encourage parents and guardians to spend time online with their children and to participate and monitor the interactive activities of their children.
The Site is only a venue. The Site acts as a venue for member companies to post casting opportunities and for candidates to post their own portfolios for the purpose of researching and evaluating casting opportunities for themselves. Casting360 does not screen or censor the profiles or other information. Because user authentication on the Internet is difficult, Casting360 cannot and does not confirm that each user is who they claim to be. Casting360 expects that you will use caution and common sense when using the Site.
Casting360 is not involved in the actual transaction between member companies and candidates. As a result, Casting360 has no control over the quality, safety or legality of the casting calls or profiles posted, the truth or accuracy of the listings, the ability of member companies to offer casting opportunities to candidates or the ability of candidates to fill casting openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Site.
You acknowledge and agree that you are solely responsible for the form, content and accuracy of any portfolio or material contained therein placed by you on the Site. Member companies are solely responsible for their postings on the Site.
Casting360 does not warrant or guarantee that a portfolio or casting call posting will be viewed by any specific number of users, or that it will be viewed by any user.
Casting360 is not to be considered to be an employer with respect to your use of the Site, and Casting360 shall not be responsible for any decisions, for whatever reason, made by any entity posting on the Site.
In no case will you hold Casting360 responsible in any way for any harm incurred by the use of our services, including any loss of income that results from use of Casting360 services.
You, the buyer, may cancel this agreement, without penalty or obligation, at any time prior to midnight of the original contract seller's tenth business day following the original date of this contract, excluding Sundays and holidays. To cancel this agreement mail, fax or deliver a signed and dated notice, or send a telegram, which states that you, the buyer, are canceling this agreement, or words of similar effect. This notice shall be sent to: Casting360, Attn: Cancellations, 182 Howard St #412, San Francisco, CA 94105 or faxed to (877) 734-7331. Please include your Casting360.com username and email address in any correspondence or your refund may be delayed.
If you send, fax or deliver the notice to cancel your subscription agreement within such ten day period, we will refund the full amount of your registration.
